Legalitas Praktik Remediasi Sampah Antariksa Berdasarkan Hukum Internasional

Abstract

Remediasi merupakan salah satu metode paling efektif dalam menanggulangi permasalahan peningkatan jumlah sampah antariksa, di mana saat ini jumlahnya melebihi objek antariksa yang masih berfungsi di orbit bumi. Namun, praktik tersebut mengalami kendala dalam upaya implementasinya secara global karena adanya kekosongan hukum internasional yang mengatur secara spesifik mengenai remediasi sampah antariksa, sehingga terdapat beberapa kendala terutama yang berkaitan dengan prinsip kepemilikan atas objek antariksa. Tulisan ini akan membahas mengenai ketentuan-ketentuan dalam sumber-sumber hukum internasional serta pengaruh keberadaan praktik-praktik negara secara individu maupun kolektif yang mendukung pelaksanaan praktik remediasi sampah antariksa. Penelitian ini menggunakan metode pendekatan yuridis normatif dengan pengumpulan data sekunder berdasarkan instrumen hukum internasional dan teori-teori hukum internasional yang berlaku berkaitan dengan fakta-fakta dalam praktik remediasi sampah antariksa. Teknik analisis data dilakukan secara yuridis kualitatif sehingga menghasilkan data yang bersifat deskriptif analitis. Hasil penelitian ini menunjukkan bahwa Artikel IX Outer Space Treaty 1967 dapat dijadikan sebagai dasar hukum pelaksanaan remediasi sampah antariksa yang didukung oleh beberapa sumber hukum internasional lainnya serta pemuatan aturan pelaksanaannya dalam hukum nasional negara-negara.
